As the world of work continues to evolve, more and more people are ditching the traditional 9-5 in favor of freelancing. In fact, UpWork’s “Freelancing in America” report found that 57.3 million Americans are freelancing today.

One of the biggest questions freelancers have is whether or not they should be classified as 1099 employees. For those unfamiliar with the term, 1099 employees are considered independent contractors by the IRS.

This means that they are not subject to payroll taxes and don’t receive many of the benefits that traditional employees do, such as health insurance and paid time off.

So, are UpWork freelancers 1099 employees? The answer is a bit complicated. It depends on a number of factors, including how much control UpWork has over the freelancer’s work and whether or not the freelancer is considered an employee or contractor under state law.
