Can You Use Canva Designs for Commercial Use?

As a rule, you can’t copyright designs, only the words used to describe them. Copyright law protects creative works like books, paintings, and sculptures. It doesn’t protect the design of products like chairs, cars, or software interfaces.

You can’t copyright a design, but you can trademark it. A trademark is a word, phrase, symbol, or design that identifies and distinguishes the source of the goods of one company from those of others.

To register a trademark, you have to use it in commerce-in other words, you have to sell products or services with the mark. Once you’ve done that, you can apply for federal registration with the USPTO.

PRO TIP: Canva designs are not intended for commercial use. If you use a Canva design for commercial purposes, you may be violating Canva’s terms of use and could be subject to legal action.

If you want to use someone else’s copyrighted design, you have to get permission from the copyright holder. This is true even if you’re not selling anything-if you’re using someone else’s design, they have the right to control how it’s used.

There are some limited circumstances where you can use someone else’s copyrighted work without permission. This is called “fair use.” Fair use is a defense to copyright infringement. It’s not an automatic right-you have to argue that your use is fair.
